
As a subscriber to cable television service, you are entitled under Section 631 of the Cable Communications Policy Act of 1984 (the "Cable Act") to know the limitations imposed upon cable operators in the collection and disclosure of personally identifiable subscriber information, the type of personally identifiable information collected, how subscriber information is used, under what conditions it is disclosed, the period during which it is maintained, and the rights of subscribers concerning such information and its disclosure.
This law relates only to personally identifiable information. It also applies only to information that you have furnished to us or certain information that is transmitted over our cable facilities. Some of our services permit you to direct communications outside of our system. This law does not apply to information in communications you have directed outside of our system, for example, over the facilities of online providers or over the Internet.
In order that we may render services to you, we keep regular business records that contain the following types of personally identifiable information: your name, address, telephone numbers, social security number, credit information, and a subscriber correspondence. Our records include information on billing, payment, damage and security deposits, maintenance and repairs, how many television sets are in your home, the service options you have chosen, your PC configuration (for data and Internet service), and the number [and location] of converters or other cable equipment installed in your home. We also keep records of research concerning subscriber satisfaction and viewing habits, which are obtained from subscriber interviews and questionnaires. (We also keep records showing the movies and events you have ordered on our pay-per-view channels.) Additionally, if you rent your home, we may have a record of whether landlord permission was required prior to installing our cable facilities as well as your landlord's name and address. In addition, to render the High Speed Data and Internet Access Service to our subscribers, the cable system automatically collects information on subscriber use of the Service, including information on the choices that a subscriber makes along the range of services offered, when a subscriber visits a site, and how long he or she visits the site. Our uses of the information are limited to the purposes listed below.
Without appropriate written or electronic consent from you, we cannot collect personal information over the cable systems unless it is necessary to provide cable or other service you have requested or to prevent unauthorized access to services or to subscriber data. We will collect information contained in High Speed Data and Internet Access Service transmissions directed to Time Warner Cable because it is necessary to provide a service you have requested.
Time Warner Cable considers the information contained in the business records we keep to be confidential. Unless prior written or electronic consent is obtained, personal information that we maintain related to our subscribers will be disclosed only when it is necessary to render or conduct a legitimate business activity related to the cable and other services we provide, or if such disclosure is required by court order and the subscriber is notified of such order, or if disclosure is otherwise consistent with the Cable Act as summarized in this Notice.
Our detailed business records are used (and personal information contained in them disclosed) generally to help make sure you are being properly billed for the services you receive, to send you pertinent information regarding your cable services, to improve the quality of the services we provide, and for all tax and accounting purposes.
Specifically, the information in these records is used to sell, install, maintain, and disconnect cable services, as well as to bill and collect service-related charges, to measure subscriber satisfaction and improve marketing and program decisions, to mail related materials, to ensure compliance with relevant law and contractual provisions, and to answer questions from subscribers. The information on subscriber use of High Speed Data and Internet Access Service is used to understand subscriber reactions to the gateways and services we offer and to evaluate the network. It helps us to customize the High Speed Data and Internet Access Service based on the interests of subscribers, and helps us to be more selective in the types of commercial communications we address to you. We take all reasonable precautions to prevent unauthorized access to this information.
The types of persons to whom information about you may be disclosed in the course of our cable business include our employees, the employees of related legal entities, agents, repair and installation subcontractors, sales representatives, accountants, billing and collection services, program guide distributors, mailhouses, program suppliers, consumer and market research firms, authorized representatives of governmental taxing of regulatory authorities, software vendors, and merchants or advertisers offering services to you over the High Speed Data and Internet Access Service.
Information for billing purposes and program guide mailings is generally provided on a monthly basis. Information for other purposes is provided at a frequency dictated by the particular business need. We will maintain information about you only so long as it is necessary for our cable television business purposes. This period of time lasts as long as you are a subscriber and up to fifteen additional years so we can comply with tax and accounting requirements.
Unless you object, the Cable Act allows us to disclose information to others, including advertisers and direct mail or telemarketers, for non-cable-related purposes, including product advertising, direct marketing, and research. Disclosure for such purposes is limited to your name, address, and the particular services to which you subscribe, but cannot include the extent of your viewing or use of a particular service or the nature of any transaction you may make over the cable system. We screen requests to use our mailing list to ensure they are appropriate and typically provide names and addresses of subscribers to third parties as often as requested. If you wish to have us remove your name from such lists, please contact us at the system office. We will then not make your name and address available for such non-cable purposes. Time Warner Cable does not provide electronic mail addresses of our customers to third parties for commercial purposes.
Other than the information provided to governmental taxing or regulatory authorities in furtherance of our legitimate business purposes, Time Warner Cable shall not make personally identifiable information available to government authorities in the absence of a court order and shall promptly notify the subscriber of any such request prior to responding. At such court proceeding, Federal law requires the governmental agency to offer clear and convincing evidence that the subject of information sought would be material evidence in the case. The subject of the information must be afforded the opportunity to appear and contest the agency's claim.
You have the right to inspect our records that contain information about you and to correct any errors in such information. If you wish to inspect our records at our local business office, please notify us in writing and an appointment will be arranged promptly during our regular business hours. Additionally, as a cable subscriber, the Cable Act provides you with a cause of action for damages and attorney's fees and costs in federal District Court should you believe that any of the limitations on the collection, disclosure, and retention of personally identifiable information have been violated by us.
